How you appear across the club site — rosters, teams, leaderboard. Two fields, both required. Must reasonably match the name the club has for you.
1. THE ACTIVITY. I am voluntarily taking part in cricket matches, practice sessions, and related activities organized by the North Austin Cricket Club ("NACC"), played with a hard tennis ball, at Spicewood Elementary, Deep Wood Elementary, Williamson County Cricket Ground, the Round Rock practice park, and any other ground NACC uses, throughout the year and on some weekdays.
2. ASSUMPTION OF RISK. I understand that cricket with a hard tennis ball carries inherent and other risks, including but not limited to: being struck by a ball or bat; collisions with other players, equipment, trees, benches, fences, or fixed objects; slips and falls on uneven, wet, muddy, or hard ground; extreme heat, cold, wind, rain, or other weather; overexertion; and the acts or omissions, including the NEGLIGENCE, of other participants. I understand these risks can result in bruises, fractures, concussion, eye, dental, or facial injury, permanent disability, or death. KNOWING THESE RISKS, I VOLUNTARILY ACCEPT AND ASSUME ALL OF THEM, whether known or unknown.
3. RELEASE AND WAIVER OF LIABILITY. In consideration for being allowed to participate, I RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE the North Austin Cricket Club and its organizers, administrators, captains, players, volunteers, and the owners of the grounds we use (together, the "Released Parties") from ANY AND ALL claims, liabilities, demands, damages, or causes of action for any injury, harm, loss, or damage arising out of or related to my participation — INCLUDING CLAIMS CAUSED BY THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES — to the fullest extent permitted by Texas law. This release does not apply to gross negligence or intentional misconduct.
4. INDEMNIFICATION. I agree to indemnify and hold the Released Parties harmless from any claim, loss, or expense (including attorney's fees) brought by me or on my behalf arising from my participation.
5. FITNESS & MEDICAL. I affirm that I am physically fit to participate and have no medical condition that makes it unsafe for me to do so. I consent to receive emergency medical treatment if needed, and I am responsible for any cost of that treatment and for maintaining my own health and accident insurance.
6. PROTECTIVE EQUIPMENT. I understand that an abdominal guard is REQUIRED, and that a helmet, gloves, and other protective gear are strongly recommended. If I choose not to wear recommended equipment, I do so at my own risk.
7. RULES & CONDUCT. I agree to follow all NACC rules and the instructions of admins and umpires, and to conduct myself safely and respectfully toward everyone on the field.
8. MEDIA. I grant NACC permission to use photographs, video, and scorecards that include me in club communications and social media. I may opt out by written request to an admin.
9. MINORS. If the participant is under 18, a parent or legal guardian must sign this agreement on the minor's behalf, agreeing to all of its terms and indemnifying the Released Parties for the minor's participation.
10. GENERAL. This agreement is governed by the laws of the State of Texas. If any part is held unenforceable, the rest remains in full effect. This is the entire agreement between me and NACC regarding these matters, and no oral statement changes it.
11. ELECTRONIC SIGNATURE. I understand that typing my name and submitting this form is my electronic signature under the U.S. E-SIGN Act and the Texas Uniform Electronic Transactions Act, with the same legal effect as a handwritten signature. I understand my name, the date and time, my IP address, and the version of this waiver are recorded as evidence of my agreement.
ACKNOWLEDGMENT. I have read and understood this entire agreement. I am at least 18 years old (or a parent/guardian signing for a minor). I sign it freely and voluntarily.
